Terms of Service

These Terms govern your use of Klinikfy. By creating an account or using the service, you agree to them. Please read them carefully — they cover what you can expect from us and what we expect from you.
1. Eligibility
You must be at least 18 years old (or have verifiable parental consent) and a resident of Malaysia (or otherwise able to transact in Malaysia) to use Klinikfy. By using the service, you represent that you meet these requirements.
2. Your account
You are responsible for:
- Keeping your password and login credentials confidential.
- All activity that occurs under your account.
- Providing accurate, current, and complete information when signing up and booking.
- Notifying us promptly at support@klinikfy.com if you suspect unauthorised access.
3. Acceptable use
You agree not to:
- Use Klinikfy for any unlawful purpose or in violation of any applicable laws or regulations.
- Impersonate any person or entity, or falsely state your affiliation with a person or entity.
- Upload or transmit viruses, malware, or any code designed to disrupt or compromise the service.
- Attempt to gain unauthorised access to other accounts, systems, or networks connected to Klinikfy.
- Scrape, crawl, or use automated means to access the service or extract data without our written permission.
- Use Klinikfy to send spam, harassment, or unsolicited communications.
4. Clinic-owner obligations
If you operate a clinic on Klinikfy, you additionally agree to:
- Hold all necessary licences, registrations, and professional credentials to practise your medical specialty in Malaysia.
- Provide accurate clinic information, doctor profiles, services, opening hours, and pricing.
- Honour all appointments booked through Klinikfy, except where prevented by genuine emergencies, in which case you must notify the patient promptly and offer a reschedule.
- Comply with the Personal Data Protection Act 2010 when handling patient data accessed through Klinikfy. You are the data controller for patient data you receive; Klinikfy is the data processor.
- Maintain professional indemnity insurance appropriate to your practice.
5. Patient obligations
If you book appointments as a patient, you additionally agree to:
- Provide truthful information about your identity, contact details, and medical history relevant to your appointment.
- Attend your appointment on time, or cancel in advance if you cannot make it.
- Not use Klinikfy for medical emergencies — in an emergency, go to the nearest hospital or call 999.
- Treat clinic staff and clinicians with respect.
6. Plans & payment
Klinikfy offers a free plan and optional paid plans. Paid plan details and pricing are available on our Pricing page. By upgrading to a paid plan, you agree to pay the applicable fees. Fees are non-refundable except as required by Malaysian law or as explicitly stated at the time of purchase.
We may change pricing for future billing cycles with at least 30 days' notice. Your continued use after the change takes effect constitutes acceptance.
7. Intellectual property
Klinikfy, our logo, and the look and feel of the service are owned by us and protected by Malaysian and international intellectual-property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
You retain ownership of content you upload (clinic photos, doctor bios, etc.). You grant us a worldwide, non-exclusive licence to host and display that content as needed to operate the service.
8. Cancellations & refunds
Cancellation policies are set by each clinic and shown clearly at the time of booking. Refunds, where applicable, are processed through the original payment method.
For Klinikfy subscription fees, you may cancel at any time and continue to use the service until the end of the current billing period. We do not provide prorated refunds for partial months, except where required by law.
9. Termination
We may suspend or terminate your account if you breach these Terms, pose a security risk, or if we are required to do so by law. Where reasonable, we will give you advance notice and an opportunity to remedy the issue.
You may terminate your account at any time from your account settings.
10. Disclaimers
The service is provided “as is” and “as available”. To the maximum extent permitted by Malaysian law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Klinikfy is a booking and management platform. We do not provide medical advice, diagnosis, or treatment. The clinicians and clinics on the platform are independent professionals who are solely responsible for the care they provide.
11. Limitation of liability
To the maximum extent permitted by Malaysian law, our total aggregate liability to you for all claims arising out of or relating to the service shall not exceed the greater of: (a) the amount you paid us in the 12 months preceding the claim, or (b) MYR 100.
We will not be liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or goodwill.
12. Indemnification
You agree to indemnify and hold harmless Klinikfy, its directors, employees, and agents from any claims, losses, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the service.
13. Disputes & governing law
These Terms are governed by the laws of Malaysia. Any dispute arising out of or in connection with these Terms shall first be resolved through good-faith negotiation. If that fails, the dispute shall be referred to mediation, and finally to the courts of Malaysia.
14. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. For material changes, we will notify you by email or in-app notice at least 14 days before the change takes effect. Your continued use after that date constitutes acceptance.
